The firm, celebrating its 17th year of successful practice, is particularly proud of the Killingsworth case as an example of its philosophy. At stake was the company name. "It was a bet-the-company case," Clark says. A predatory competitor that held the federal registration to "Killingsworth" moved into the company's territory and brought suit in federal court to stop the company from using the name it had used for years. Clark counterclaimed and secured a full injunction and nearly $2 million in damages and fees. The court also ordered the federal trademarks held by the other company to be canceled for fraud. "If we had lost, the company would not have survived," Clark says.


The case was especially meaningful for Clark because Killingsworth is a secondgeneration company. In fact, the father and founder of the company, Sterlyn Killingsworth, wrote one of several recommendations for Clark to enter law school. "The case meant a lot to me personally because it made a huge impact upon a family that I had known for decades," Clark says. "The family had placed their faith in me in their time of need and I was not going to let them down. Although my relationship with the Killingsworth family was special, I believe the case exemplifies our mission here at Clark Goldberg Madruga-we take care of our friends in need."
